STRASBOURG, April 26, 2007 (LifeSiteNews.com) - In a disgraceful debate in the European Parliament (EP) yesterday, Members of the European Parliament from France, the Netherlands and Italy, among others, vilified Poland as % ful" and "repulsive" for refusing to allow promotion of in schools.

A vote was held today to approve an EP resolution chastising Poland for 'homophobia.' The resolution - adopted by 325 votes to 124, with 150 abstentions - calls for a fact-finding mission to be sent to Poland, for "worldwide de-criminalisation of " and for the Commission to take Member States to court if they breach their EU obligations.

At issue was a proposed law in Poland which would forbid " propaganda" in schools. Explaining the legislation earlier this year, Roman Giertych, Poland's minister of education: "One must limit propaganda so that children won't have an improper view of family"

Die so genannte Homo-Ehe muss bei der Zusatz-Altersversorgung im Öffentlichen Dienst nicht wie eine normale Ehe behandelt werden. Der Bundesgerichtshof (BGH) in Karlsruhe wies die Klage eines Mannes ab, der als Angestellter eine Gleichstellung der eingetragenen Lebenspartnerschaft gefordert hatte. Der Mann hatte geltend gemacht, er wolle bei der Zusatz- Altersversorgung wie ein verheirateter Angestellter behandelt werden.

Der Kläger hatte eine Neuberechnung seiner Rentenanwartschaft für den Termin 1. Januar 2002 gefordert. An diesem Tag war die Reform der Zusatzversorgung im Öffentlichen Dienst in Kraft getreten. Nach seiner Ansicht hätte ihm für die Berchnung der Zusatzversorgung die für Verheiratete geltende und günstigere Lohnsteuerklasse III/0 zugestanden. Außerdem hatte der Kläger die Garantie einer Hinterbliebenenrente für seinen Partner im Todesfall gefordert.

Richterspruch: Privilegierung der EheDie Bundesrichter entschieden dagegen, das Grundgesetz lasse eine Privilegierung der Ehe zu. Die Satzung der Versorgungsanstalt des Bundes und der Länder knüpfe an den Familienstand an. Die Ehe dürfe wegen der Fortpflanzung und Erziehung eigenen Nachwuchses bevorzugt werden.

Adoption, when 'discriminating' makes perfect sense and gender is relevant

The United Kingdom is about to repeat the ill-treatment of the Catholic Church pioneered in Boston. The government of the UK may effectively shut down the nation-wide Catholic adoption services rather than grant a religious exemption to the new law requiring equal treatment on the basis of ual orientation. The Archbishop of Canterbury along with the Muslim Council of Britain have both stated their support of the Roman Catholic Church.

The churches are correct: non-discrimination in adoption is an -centred policy, despite its supporters’ best efforts to depict it as child-centred. The demand that every adoption agency in the UK take no notice of ual orientation is irrational and incoherent.

The best pro-child argument that proponents have is the claim that children are better off with gay couples than “languishing in foster care”. Notice the tacit admission that gay couples are not the first choice: the first choice is heterosexual, stable, married couples, who are simply too few in number to meet the needs of all the children.

But this claim, even if true, does not justify the new British policy. British law does not permit adoption agencies to line up prospective adoptive parents in order of desirability, and then work its way down the list until all the adoptable children have been allocated. No. Non-discrimination law insists that neither marital status, nor ual orientation, can even be considered as a factor in placing children with adoptive parents. Besides, Catholic adoption agencies handle about a third of all adoptions of children considered difficult to place.

Sisters go to court over 'gay bias' in tax laws

Two sisters in their eighties, who face a hefty bill for inheritance tax when the first of them dies, will accuse the Government of discriminating against heterosexuals when their challenge comes before the European Court of Human Rights this month.

The test case is the first of its kind since the law was changed to allow gay and lesbian partners the same inheritance rights as married couples.

Joyce Burden, 88, and her sister Sybil, 81, inherited their house, near Marlborough, Wilts, from their parents.

The sisters worked as land girls on their father's farm during the war but never married, caring for their parents and two aunts until they died.

They have lived together all their lives and made wills in favour of each other.

Their house, which cost £7,000 to build in 1965, is valued at £875,000. But the sisters fear it will have to be sold when one of them dies in order to pay inheritance tax estimated at £236,000.

Property left by one spouse to the other or inherited by a civil partner is exempt from the tax. However, close relatives, such as siblings and descendants, are not eligible to register as civil partners.

Joyce Burden said she thought people like her were deliberately excluded from the recent Civil Partnership Act because there were so many homosexuals in Parliament.

"I don't have the status of a lesbian," she said. "This is an insult to single people who have looked after elderly parents. I don't call that justice."

She and her sister had been trying for 31 years to get the law changed. She hoped that a victory at the court would help others in their position.

"We have not enjoyed our old age with this hanging over us," said Miss Burden.

At a hearing on Sept 12, the sisters' lawyers will argue that the inheritance tax laws breach their right to enjoy their property under the first protocol to the Human Rights Convention, coupled with the anti-discrimination provisions of Article 14.

Emma Stradling, the sisters' lawyer, said they had spent their lives in a stable, committed, supportive and loving relationship with each other.

The Government's position was that the relationship between siblings was different from that of couples.

"Couples enjoy a relationship of choice. Siblings however, enjoy a relationship of consanguinity. Further, the relationship between siblings is for ever, whereas couples may part."

In the Government's view, she said, a couple made a financial commitment by making a personal commitment to each other. This was not the case with siblings.
